British Telecommunications PLC & Ors v Telereal Securitised Property Trustee 1 Limited & Ors:
Complex and high value Part 7 proceedings in the Chancery Division (Business List) between seller and successful bidder, flowing from BT’s 2001 restructuring of its property holdings through sale and leaseback arrangements. Anthony de Garr Robinson KC and Moritz Grimm act for the Claimants - instructed by CMS.
LCN Sapphire Trustee 1 Limited & Anor (as trustees of the Webb Sapphire Property Unit Trust) v Wiseman & Ors:
Commercial Court proceedings flowing from an aggressive restructuring that left several companies within the corporate group unable to meet their liabilities. LCN alleges (in Part 7 proceedings) that the restructuring involved an unlawful means conspiracy among entities and individuals within the Aurelius Group. LCN has commenced Norwich Pharmacal proceedings against the current sole director of AAH (Wiseman), former directors of AAH and its parent company, Admenta UK, and the joint liquidators of AAH in order to identify the alleged co-conspirators and uncover the full extent of the conspiracy. AZ V BY [2024] EWHC 1847 (Comm):
For the seller of liquified natural gas cargoes in the Commercial Court on an arbitration dispute, engaging questions of the construction of arbitral awards and the doctrine of functus officio; and subsequently on appeal to the Court of Appeal (Feb 2025, judgment pending).
