Lord Hodge was admitted to the Faculty of Advocates in 1983 and appointed Queen's Counsel in 1996. He was appointed a Senator of the College of Justice in 2005, serving until 2013, during which time he sat as a Commercial Judge and the Scottish Judge in Exchequer Causes, as well as one of the Scottish Intellectual Property Judges and as a Judge in the Lands Valuation Appeal Court. Whilst serving as a judge of the Court of Session in Scotland, he was instrumental in modernising judicial procedures, advancing effective case management, and the practice of its commercial court.

Lord Hodge was appointed a Justice of the UK Supreme Court and the Judicial Committee of the Privy Council on 1 October 2013, and became Deputy President of the Supreme Court in January 2020, a role he held until his retirement on 31 December 2025.
