One Essex Court is delighted to host a panel session event during London Arbitration Week 2026 on “When damages are not enough: specific performance and injunctions in arbitration”, taking place on Tuesday 1 December 2026.
When damages are not enough: specific performance and injunctions in arbitration
A damages award may offer little comfort to a business that needs its supplier to keep delivering, its joint venture partner to transfer shares, or its counterparty to stop using confidential information. When can arbitration deliver the commercial outcome the client actually needs?
This session will explore specific performance and final injunctions in commercial arbitration. It will examine the relationship between the tribunal’s powers and the applicable law, when damages may be inadequate, and how considerations of supervision, proportionality and commercial practicality affect the relief sought.
Through practical commercial scenarios, the discussion will consider how to frame an order that is precise, workable and capable of enforcement. What happens when performance depends on a third party, requires continuing cooperation or must take place overseas? What can be done if the losing party refuses to comply? The focus will be on choosing and securing remedies that achieve the client’s objectives in practice.
The panel will include Lord Richards, Dame Elizabeth Gloster, Alexander Brown KC and Eleanor Campbell.
