Premier Inn, the UK’s largest hotel brand, successfully defended a claim for trade mark infringement brought by easyGroup.
easyGroup took issue with the adoption by Premier Inn of the words ‘Rest easy’ as part of its advertising and marketing. It brought proceedings for trade mark infringement and also made a claim for invalidity of a trade mark registration owned by Premier Inn.
In a comprehensive judgment, which included consideration of survey evidence put forward by easyGroup, the trial judge, Deputy High Court Judge Lance Ashworth KC, dismissed all the claims advanced by easyGroup.
